Abstract: The author of the article titled „Some logical problems of the criminal justice system“ discusses the basis for determining the logical problems of criminal responsibility, which has been proposed in the edition of 1999 of the Criminal Code of Georgia. He analyzes the logical errors, which are typical for the German criminal normative theory and that are reflected in scientific and dogmatic studies, partly inherent in the Georgian criminal legislation. In the base of studies carried out by author, the new definition of the crime concept was developed which is more in line with the provisions of the Criminal Code of Spain.
